Can you point me to where the judge is showing enthusiasm or lack of it? I thought the whole point of him being impartial was that he wasn't their to do either. His job is to follow the rule of law.

You are free to opt in or not opt in as you see fit. How do you know what the opt in is about before deciding. From your post you have suggested that you have a lot of shares and it cost you thousands. Would you not also have more to gain with a positive out come?

What are you currently doing to with your shareholder vote to help yourself and other shareholders? Are you satisfied accepting whatever Tenor and Fung leave you with?

This isn't meant to be specific to you so don't take this the wrong way.In an earlier post I mentioned members not taking the time to even write their complaint out for a board I chaired. I view the concept of letting others doing the work and then trying to steer their own wheel as simply not caring about what they get. With summer upon us the analogy I would use is a wood tick.
