I am uncertain why you are all ignoring the quickest way to make our voices heard. which I pointed out several days ago. BMH's friend may be a significant stockholder who will take steps to file an appearance as an amicus curiae(friend of the court) or similar but there already is a significant sharehlder who is represented by counsel in the matter. As I suggested, why not express your concerns either directly to him or through his attorney and see if he will raise them with the court. After all, if you have something of value to add, he is on your side and would like to hear what you have to say so he can make those concerns known to the court through his attorney. I have many decades of experience as a trial lawyer and that is what I would do.
