There is a new order from the court of appeals dated May 29. However, it is not an order that decides the merits of the appeal. It does, however, increase the DIP loan and gives kry the ability to borrow an additional $4 million on the DIP. The court of appeals has not yet issued an order on the merits of the appeal.
