teut, with a closing expected OCT 28th they must already have the purchasers lined up (my guess is macquire and friends)... my main concern would be a "first right to payment" provison... i.e. the first $500mil goes to cvr holders... this would prompt management to take an early settlement imo...

we'll see, but at this point any financing is a good thing.
