KRY first gave notice to VZ of a dispute on Nov 28, 2008. GRZ first gave notice on or about April 20, 2009. So at that point we had a 145 day time advantage on GRZ. GRZ filed on Oct 21, 2009. We filed on Feb 16, 2011.

Not to mention KRY's dire cash position relative to GRZ's which was even more of an argument for having filed in 2008 as many of us paying shareholders were urgently calling for. Fung took the big gamble with other people's money. We now know that shareholder value has been diminished...not enhanced by this incorrect decision.
