brun/turtle, lost profits are within icsid's right to award. i'm not saying kry wont get lost profits but from what i see (see autopista v. ven) in order to get lost profits you must demonstrate a history of profitibility. given kry's history of mining in ven and other miners non-profitibility in ven this may not be an automatic win.

i'm only guessing (but it's a somewhat educated guess)...if kry goes all the way i'd place money on $750mil-$1bil being a pretty solid award based solely on investment/interest/exchange/etc.... lost profits i view as a crap shoot.

at least we can discuss this now, i tried to bring this up months ago and almost got my head tore off..

if you want some real boring reading. look at the case details on the icsid site...i'd start with the concluded cases vs venezuela. the only "lost profit" winner i can remember was a peru case (i think) but i think they were in operation when nationalized. in any case, start with the ecuador/peru/etc south american cases first. they seem more relevent to us.
