Message: some thoughts

I hope everyone is doing well.

Before returning to New England and then Florida tomorrow I have had a chance to read some of the many posts. Obviously, there are many here that remain nervous and frustrated. That is understandable. Others have time limits and some want to be rid of their investment as soon as possible.

At this juncture, I can only share my opinion of the situation. I think it fair to say the Company has done everything asked of it by the Venezuelan authorities. They have maintained a valid and compliant MOC and have found a worthy JV partner to bring the development of Las Cristinas to fruition in a timely manner. This approach offers Venezuela the possibility of avoiding arbitration and getting the mine-site up and running; should they honor their verbal commitments to clear the MOC path and issue the environmental permit.

Venezuela's mismanagement, bureacracy, obvious frustration and obstructionist efforts over the years to deny Crystallex are plain to see. Nevertheless, this needs to be seen through the prism of a dramatically rising gold price. Venezuela is within their rights to say no to the JV, to embarass China, to reneg on commitments. There is however a legal consequence of such action. A deliberate breach of contract, revoking the MOC all carry a hefty penalty - both in terms of their relationship with China and the financial consequences of an ICSID arbitration award in favor of Crystallex.

From what I know, the legal agreements between Crystallex and CREC/CRRC are complete. Discussions and negotiations between all parties are complete. Timing of news remains in the hands of Venezuela. Once Venezuela is ready and they have in place what they need to make an announcement then we will have a material event and thus a press release. That may come before or after the next quarterly financials.

I am confident that we will receive positive news. The market will then determine a value to apply to Crystallex - much higher than current pricing. In the event that Venezuela takes a different path then we resort to arbitration.

I am not worried or concerned about the outcome. We will all know very soon. I prefer not to get involved in Hugo bashing or discussion of bribery etc, that is counter productive and not a good reflection on the shareholders at large so I will wait for Venezuela to do the right thing and respect their decision not to - in which case we embark upon a different approach.
