I do note one VERY different statement and that is that KRY is IN discussions. Always before it has been that they are pursuing solutions/transactions. Now it apears they have found someone willing to talk.

I'd say the second part on arbitration may mean this discussion partner may also finance arbitration since we can't.

My take is very positive either way. Let's see how EOD and manana trade.
