Gotcha Jimmi, it just seems that the overall fact the Noteholder claim isn't hanging over KRY anymore is a positive. I can imagine that anyone else involved (strategic investor) that this would lighten the load a bit on how they go forward with a transaction and/or structure and not have this potential claim standing in the way.
