Mining contracts

For a number of years we have acted on a large volume of mining projects across a wide range of countries. We have compiled a mining convention comparator which analyses how key provisions or issues have been dealt with. This enables us to advise on what is perceived to be the market position on any key provision quickly and cost effectively, and is invaluable in obtaining cost effective solutions during negotiations.

We also advise on conflicts within mining projects, such as where governments participate both as grantor of a mining concession and as equity participant in the concession/mining joint-venture. Procedures will sometimes need to be put in place to ensure that there are no conflicts of interest, and if the joint venture company is to function properly, information barriers will need to be put in place to address private party concerns on confidentiality and good corporate governance. We have the experience and knowledge to assist in this area.
