Thanks Mayo I saw this same reply posted on Yahoo yesterday. There are a few positive words in there that are different from previous replies:

Crystallex is cautiously optimistic that its activities seeking a resolution/solution to the Las Cristinas Dispute/Saga will be fruitful. The Company has the option to file a claim for damages and compensation at the ICSID but to date the activities we are involved in suggest that we are heading towards a prudent and more timely solution/resolution than International Arbitration. Should that change and Crystallex files a Claim/Action a press release and regulatory filing will be made.
