Bankruptcy

Dumb question but here it goes...How can KRY management just declare bankruptcy without having a major legal problem?

I know they are protected but if we are in a position where we cannot proceed to arbitration, that seems to be gross negligence.

Dating back to the days of the "shortly after Easter" comment and knowing the general history of Chavez, they had to know that a legal proceeding could be necessary...maybe even would be necessary...
