CJR, here are the timelines listed in KRY's 6K filed 7/30 on the Class Action lawsuit. From what I understand the motion to dismiss was filed by KRY around the Aug 14 date.

"In a court order dated April 7, 2009, the lead plaintiffs were appointed and, on June 12, 2009, they filed an amended complaint. The defendants have until August 14, 2009 to file a motion to dismiss. The lead plaintiffs can file an opposition to the motion to dismiss by September 11, 2009 and the defendants have until September 29, 2009 to file any reply thereto."
