Actually, I believe there is another argument the bondholders are making. Somebody (I think it was CJR) posted an excellent article some time ago which outlined the basic legal agruments in the case. The bondholders are also claiming that that KRY's BOD's have a fiduciary duty to stop spending money on the project in light of no permit and declining financial resources.
