Actually I would take the opposite position. When things are tough the easiest thing to do is make demands and be confrontational which I believe comes from weakness. Fung doesn't play the game that way or we would have already folded our tent and left. The tough or strong position is to ignore the storm arouind you and follow the rules. Fung isn't blinking!
Force the issue with Venezuela of no Permit and force the issue of no PR with Management when there ACTUALLY are instances of "material change" occuring, like NOW. Enough of this "STALLING from Venezuela, and silence from KRY Management.
The issue has already been forced by Kry and the deadline given VZ is May 28th. After May 28th we have a whole new game.
Prepare and Go For Arbitration. No more stalling. Enough !!!!!!!! KRY can negotiate when the pressure is on Venezuela, not on KRY.
Kry is already preparing for arbitration in case a solution can't be reached. This is why we have already hired a legal team experienced in deaking with VZ. This is why we have hired a firm to negotiate with the bond holders. Just because Kry doesn't run around threating VZ publically doesn't mean poker isn't being played behind closed doors.
And I'll bet you that we'll do better in Arbitration than anything that KRY Management presents shareholders.
I can't disagree with you on the matter of arbitration. I also think we could get a much larger settlement through arbitration. The problem is that a settlement is a bird in the hand against arbitration which is 2 in the bush.
