arbitration is very different from a court of law...

in arbitration, you're dealing with a group of "judges" who's only interest is "what' s it going to take, to make this problem go away with the least amount of upset"?

hence, they dont care who's right/wrong....

hence, there are no formal charges in icsid/world bank arbitration...

the cases are all listed by "subject matter" not "charges"....i.e. "vanessa vs venezuela" at icsid is listed as:

"subject matter: gold mining deposit"

and not,

"fraud/larceny or that f'n bean'r stole my sh^t"
