Dear Mr. Marshall,
I would appreciate clarification to the following troubling questions:
If you have consistently been advised by the Venezuelan Government throughout communications (written, spoken and in person) that “no one in Government has expressed problems for or a desire to change the Las Cristinas Mine Operating Contract, then what kind of discussions are being carried on, with whom and why.
Is Crystallex and/or its legal representatives in negotiation with Venezuelan /CVG and/or their legal representatives with regard to making any changes to the current mining Agreement ?
Is Crystallex and its legal representatives in negotiation with Venezuelan/CVG and their legal representatives with regard to making any change in the financial aspects of that Agreement,
Is Crystallex in negotiation with anyone, Venezuelan Government or Private that might be representing the Venezuelan Government, requesting changes to our existing Contracts?
If the current impasse continues until the expiry of the Notification to proceed with Arbitration, May 27, 2009 (I believe), is Crystallex filing for Arbitration with the ICSID or May 28th, or shortly thereafter?
