I was a plaintiff in a CAL initiated in 2001. We had a good case and there was very little doubt that we would succeed, but I didn't see a cent of the settlement until 2005!!! It took over FOUR years. Our CAL was against a ruthless "retailer" in the States that took over a large Canadian retailer under the guise of reformatting / restructuring the Company... they gutted the cash and basically stole the merchandise. I was a landlord (one of hundreds) that got stiffed. I was actually quite suprised when I got my cheque because so much time had gone by. I basically forgot about it.
It took four years. These guys have nothing. I don't even see it getting off the ground. Even if it did, and they were actually successful in getting a favourable decision (highly doubt it) we'll be producing gold by then at LC and any kind of cash layout to settle the CAL would not be a Company breaker.
I will agree however, this comes at a pretty crappy time. I don't know if or how badly the shareprice will get beaten up (it ain't got far to go anyway) but I guess we'll see tomorrow. Nobody said life was always easy ;-)
