ez, the fact that bi-lateral treaties are starting to show some teeth is a good thing for kry imo...
from research into prior cases vanessa's best case scenario looks to be about $140mil imo (not sure that they'll get anything because even if the purchase itself was legal, placer went past the timeline to begin mining, the same timeline would have applied to infinito and venz cancellation of the concession would apply to both)....icsid cannot award LC to infinito under any circumstances, they dont have the authority to grant the concession....
the upside is that kry would have a much better case........and the bilateral treaty will trump the "arbitration" clause in kry's contract..unless hugo were just to tell the world bank to pound salt....he started to once, then reconsidered, if he did'nt do it for exxon/etc he certainly wont do it for infinito....
