"On April 30, 2008 Crystallex reported that it was advised of a letter from a Director General in MinAmb denying the CVG request for the issue of the Las Cristinas Environmental Permit. On May 12, 2008, Crystallex submitted a formal rebuttal of the Permit denial letter to the Director General and on June 17, 2008, submitted an appeal directly to the Minister of MinAmb".

According to my records, the 90 business day appeal term in which the Minister of MinAmb was suppose to respond to Crystallex's Appeal Letter expired Oct 24 - last Friday. RM had indicated he thought the date was towards the end of Oct.

What's next? More suspense time? The way I see it - Crystallex Mgmt has these options-

1. They can be more patient and give Chavez until the Regional Election date of Nov 24 to cough up the permit. Maybe for political reasons Chavez is going to announce the LC Gold Project to win "Rangel the Rascal" some votes in the Bolivar Region( he's going to need some assistance to win the election). If KRY has not received the permit by this date, and there has been no indication KRY will be getting it, it may be time to move on.

2. After the Election, Crystallex could initiate the litigation process for project expenditures to date and the lost potential profits which the Company could have made if they would of mined the Property, or

3. Crystallex can continue to play the waiting game with Chavez, which would probably continue until he looses his power and is ousted, is assasinated, or eats himself to death.

My recommendation - Crystallex initiates the litigation process Nov 25, the day after the election, if no permit in hand. It's time we force the Chavez poker hand. Remember, Crystallex has been the good, model, corporate Company in Ven for 13 yrs. It's not like he doesn't know us. Comments.
