They Turn Aside Rio Yuruari
Thursday, 28 2008
A major multinational operating in the south of the region is being accused of diverting Yuruari River, which supplies water to El Callao and Guasipati. The situation is a year without there being any place pronouncement.

Natalie Garcia

The environmental damage from mining in general are testing the authorities did nothing to remedy the situation is the transnational Crystallex, which after a study found material below the Yuruari gold, as reported Ivan Herrera, mining in the region who has over two decades of warnings about the environmental impacts of mining and abuses against their peers.

The situation would have more than a year going, but so far no government agency-including local authorities-has bothered to investigate what happened and why this violation to the Law of the Environment and the Forestry Law, which prohibits Soil and Water any damage to the rivers and streams of the same generators whether or not hydraulic force.

"Officials have been made to turn a blind eye, there is that draws water intake of Callao and Guasipati, it appears that there is the consent of the mayors because nothing has been done ... to 9 meters of depth a gold stock market was found that located via satellite, are acting shut up and are committing a violation to the law, but worry plus the damages that the small mining does and are attributed it to her without watching at the concessions or multinationals. "Ecological Hazards

Certainly the situation is worrying because it would cause environmental impact, and its consequences for the inhabitants of these localities. Crystallex, which is famous for being the owner of the Las Cristinas project in Las Claritas, again is accused of allegedly engaging in damage to the environment, it has not yet explained how there was no open inquiry to discard these offences and reveal what appears to be a "taboo" that could be benefiting a few at the expense of the natural conditions of thousands of bolivarenses.

Significantly, the company of Canadian origin was recently approved permisologia environmental Las Cristinas for the operational phase of one of the largest and richest deposits in South America, but so far, despite all the conflicts around this mine there is a revision of the rest of activities that the company exercised within the region, as well as the fulfilment of social clauses of the draft in Las Claritas.

On the other hand, and something that is less well known-Canada alongside Australia is among the countries with greater preparation for the exercise of mining, in fact 4% of Gross Domestic Product in this country comes from these activities. As for the exploration of deposits to 30% of all projects worldwide are in the hands of companies originating in the territory, taking a high profitability for its technological readiness.

However, this should not mean action unpunished in different territories of the so-called "third world" that often serve as a "legal havens" where they work without being subjected to strict controls, as seems to occur in Venezuela that has hundreds of standards of environmental protection and only very few apply, and not to speak of sanctions levels of multinationals in comparison with the small-scale mining, artisanal mining and mineral associations, as explained Decree 295 with the rank of force Mining Act in its Chapter I, Title II, Article 7.

The law enters house

"Always critical of the small miner for the damage but did not look at the various concessions, the law is very clear in these matters and in the case of Chiguao-mine in the town recently vacated Raul Leoni 34,783-the Official Gazette dated 23 August 1991 at its 1742 decree art. 4 says' is not allowed mining in streams in the area known as Hell, The Grotto, rivers Guanan, Uaiparú, Icabarú, Parupa, Eurupuchi, Barrialón, Chiguao, Karum, Paragua, Oris, Aza, and ravines and Erebarí moriche grove of steady or not at the Basin high Caroní and Paragua.

Based on this section of the government it should not grant concessions or permits in those areas because it prevents jurisprudence, "I do not understand as there is a man who will say 'the Turkish Jhonny' which has concessions on the part of Chiguao, the law is for all and there should not be anyone, "says Herrera put as an example that there are inconsistencies within the same nation and ignorance of the law.

In the event that such a law had been enacted after these concessions granted-and all those affected by this article, it was logical and prudent to subject to review at the time of the expiry of the same to ensure compliance with the new opinion without violating the rights of the dealers. Thing is not the case with those who perform small and artisanal mining, which have already been hit by the various actions Theatre Operations No. 5, created in June 2005.

This military entity under the pretext of strict compliance to two interim measures ordered by courts control Ciudad Bolivar, in favour of a concession located in the municipality Raul Leoni, has taken advantage of the situation to carry out evictions based inhumanely-among others - in Article 43 of the Criminal Law of the Environment, which speaks of the degradation of soils and vegetation cover, but not so hard when it comes to ensuring compliance that must make concessions to the existing rules.

Blind, deaf and dumb

In all these, despite what publicly exposed, state agencies are made desentendidos about serious environmental problem caused by mining in general regardless of their scale and artisanal miners and small dealers do whatever they want without legislation invoked.

The Ministry of People's Power for Environment, the Ministry of People's Power for the Basic Industry and Mining, regional and local authorities appear to be blind, deaf and dumb to this situation that affects both friends and strangers in Bolivar. The case of the diversion of rivers and land degradation constitute a high risk to the survival of future generations who will be suffering from the consequences at the end, without a change of policy which the solvent problem.

Criminal Law of the Environment. Article 30. Changing flows and sedimentation.

"Anyone who obstructs or change the control system, runoff, the flow of water or natural bed of the river, or cause sedimentation of it, in contravention of the technical rules and without authorization shall be punished with arrest of three to nine months and a fine of three hundred to nine hundred days' minimum wage. "

The protective zone of the South Bolivar State was protected by the Venezuelan State in the Presidential Decree No. 942 of May 27, 1975, the Official Gazette No. 30,704, for their natural features of climate, vegetation, soils and hydrology is the main source Water for the Guri dam, the main supplier of electricity to the level of central, eastern and south of the country.
