I'm under the impression that the 1% is for TFSA "savings" accounts, but for trading accounts - the rule has been altered to 100%. This was because people were overcontributing say $100,000 and then paying the measily 1% penalty and making huge gains tax free. Correct me if I'm wrong, and do look into it.
