Sorry golfyeti but my opinion on this issue would be worth about as much as you are paying for it. Not my area of practice. But common sense tells me that there is probably a vast amount of "negotiation" which can take place involving hypotheticals, nudges and winks. All informally, without the parties being compelled to issue a news release.
