They couldn't really start buying on the open market either because it wouldn't take long for the price to go out of reach. "

No I am saying if all shareholders agree to be be bought out at $3 a share, the new shareholder(s) honours the JV agreement. And the FroO clause is not touched. The FRoO only applies if an asset sale is desired, not a share sale.
