I thought the notion of the 4 yr clause to build Schaft Creek was dealt a death blow when Elmer said that one could shoot a cannon-ball through that agreement?
The 4-year clause might exist, but if it does it has to be between Teck and Liard. If it is enforceable then we would also be subject to the build within 4 years requirement, if we are left with any of this project after Teck opts back in. It would also give us big problems if we were trying to sell our remaining percentage after the Teck decision. In the same way that we hoped it would put pressure on Teck to get out of it, it would also be a barrier to someone else investing.
Anyway, when does the 4-years start? It is not in our Agreement with Teck so we don't know what is the trigger for those 4 years, it can't be anything to do with Teck buying out our share because our contract specifically states that Teck can make the decision whether to put the mine into production or not. So four years after what?
