The only downside I see is the 4 year clause is a grey area and I confirmed this week, with the office, it's not clear that it can be enforced.

Who did you confirm this with ? Elmer and Mike not in office all week.

We have a public recording of Elmer himself saying the 4 year clause exists. Elmer would not say that on a webcast if he wasn't sure.
