The actual "build a mine" part is in a seperate agreement that we can't see, correct?

This 4 year clause is in a non public underlying agreement that dates back to the 1960's between Hecla, Asarco , Teck and now Copper Fox

What would the 40% option actually look like.??

Well for one, 40% would leave CUU with 60%. That's great.

And Teck must pay 300% expenditures, 60% of that going to CUU = 144 million
