40% back-in: A tip of the hat to TCK lawyers on this one. Paragraph 9.3 gives them a bonus of 10% control, or, depending on your point of view, takes 10% away from someone else. This will take a lot of faith in the TCK boardroom.

If Teck Cominco wishes to exercise its back-in right, it may earn;

  • a 20% interest by matching prior incurred expenditures, or it may earn;
  • a 40% interest by matching three times prior incurred expenditures, or it may earn
  • a 75% interest by incurring four times prior expenditures and arranging all production financing.

A 40% back-in Teck will pay three times the expenditures ($70.8 million as of October 31, 2011)
