01:19 PM EST, 11/12/2018 (MT Newswires) -- Canada Carbon (CCB.V) was up 30% on Monday after the company said the Quebec Superior Court ruled against the municipality of Grenville-sur-la-Rouge's attempt to have the company's $96 million suit against it declared abusive.
Canada Carbon said the Superior Court declined to declare the action a Strategic Lawsuit Against Public Participation, though its request for $40,000 in legal costs was denied.
The company is pursuing the case after the municipality blocked a graphite mining and marble-quarrying project.
Canada Carbon will return to court on November 16 to ask that the project be allowed to proceed.
The company's shares were last seen up $0.035 to $0.15 on the TSX Venture Exchange.
