I fully agree with your comments go4, but isn't there a possible upside to the forced acquisition process? It has been stated that this is an automatic order, but I can't grasp that there has to be a court hearing if it is truly automatic. My understanding, which I admit is not based on personal knowledge but rather posts to this Forum, is that both sides may make representations to the Judge to assist him/her in establishing a fair value for the shares.

Since 90% at least at that point will have accepted the offer, our chances would appear to be quite slim. BUT, I venture to say that in few takeovers would the shareholders have the evidence we have to point to a much greater value than that of the offer. As well, by that time events may have produced even more solid evidence that we were jobbed, as we already know.

THIS IS NOT A TYPICAL CASE! Dare I say it is unique?

HANG ON TO YOUR SHARES IF YOU POSSIBLY CAN!
