What i'm unsure about is that, can K purchase ARU shrs while going thru and acquisition?

Kinross is not supposed to buy any ARU during the offer period which has been extended to Sept 15, 2008 !! See Below fro the offer....

12. Market Purchases
The Offeror has agreed with Aurelian that from the date of the Support Agreement until the Take-Up
Date, it will not purchase any Aurelian Shares except under the Offer or pursuant to the Private Placement. The
Offeror has also agreed that it will tender all of the Aurelian Shares acquired by way of the Private Placement to
a Superior Proposal or vote in favour of a Superior Proposal, if applicable, if (a) the Offeror does not exercise its
right to match pursuant to the Support Agreement, and (b) the Support Agreement has been terminated
pursuant to its terms.
Although the Offeror has no current intention to do so, subject to compliance with applicable securities
laws, the Offeror reserves the right to make or enter into an arrangement, commitment or understanding prior
to the Expiry Time to sell after the Expiry Time any Aurelian Shares taken up and paid for under the Offer.
