Chapter 7
Rights of nature
Art. 72 .- The nature or Pachamama, where he plays and conducts life, has the right
to respect fully their existence and maintenance and restoration of their
life cycles, structure, functions and evolutionary processes.
Everyone, community, village or nationality may require the public authority
fulfilling the rights of nature. To apply and interpret these rights
will observe the principles enshrined in the Constitution, as appropriate.
The state will encourage a natural and legal persons, and groups to
protect nature and promote respect for all elements that form a
ecosystem.
Art. 73 .- The nature has the right to the comprehensive restoration. This restoration Sera
independent of the obligation of the State, and natural or legal persons
to compensate individuals and groups that depend on natural systems
affected.
In cases of serious or permanent environmental impact, including those caused by
exploitation of non-renewable natural resources, the state established the
more effective mechanisms to achieve the restoration, and action
adequate to eliminate or mitigate adverse environmental consequences.
Art. 74.-The State implemented precautionary measures and restrictions for activities that
can lead to the extinction of species, destruction or alteration of ecosystems
Standing natural cycles.
The entry of organisms, organic and inorganic materials that can
permanently alter the genetic heritage.
Art. 75.-Individuals, communities, peoples and nationalities are entitled to
benefit the environment and natural resources that enable them to the good life.
Environmental services are not subject to appropriation; their production,
delivery, use and exploitation are regulated by the state.
