In the absence of the opposition, the plenary Assembly yesterday approved four articles over the new constitution, relating to property.
The text expressly prohibits the confiscation, but indicated that the state institutions, "for public use or social interest and national levels", may declare the holding of property, "after fair valuation, payment and compensation." This article was adopted with 86 votes.
Irina Cabezas (PAIS), vice president of the table 6, and held that the State sectional and governments may run social development plans, such as housing or roads. For Francisco Cisneros (SP), the only opposition that remained in full, as part of the table 6, said that the countries are trying to eliminate private property.
Norman Wray (PAIS) said that the law shall regulate the appropriate due process to proceed with expropriation.
According to the articles adopted, the State recognizes and guarantees the right to publicly owned, private, community, state, associative, cooperative and mixed, "provided they meet the environmental and social function."
Wray noted that the first concept has to do with the need to produce land, and second, that there is minimal environmental impact.
